Justice v. Law

On of the things that readily becomes apparent in the cases that we read is that what is legal is often not just. Now this probably wouldn’t come as a surprise to almost anyone these days (though certainly we usually hear about when injustice is done, not justice, but that’s another matter), but it is interesting to see the judges themselves struggling with this concept. It comes up the most in contracts.

The vast majority of contracts cases so far involve A making a promise to B, usually to pay him money, A dies, and then the executor of A’s estate refuses to make good on the promise (whether it is written or not is not important). Naturally
